I can tell you from experience that there is absolutely no way he is going to get anything like £2.5 million exemplary damages.
I thought the Derby advert was brilliant, but the Ascot one is a bit silly.
Since TB’s cannot be dun, the foal was most likely to be one of those pale bay colours that looks a bit golden. Light bay foals are often born with quite a bit of white/sandy colour through their coat. When they shed the baby coat the hair grows back through with a lot more black colouring. An easy mistake to make.
Actually, foals are generally born a lot lighter than their final adult colour. My horse, who is in my profile picture, was born completely pale cream colour. He is now a rich gold.
Below are pictures of a bay foal and a dun foal. They look quite similar!!

Come on Andy, horses are not machines. DA just had a torrid time in the Derby where he pretty much bolted. Bolger will need to take time to train him to settle again, and maybe he since he got a fright in the stalls he will need to have his confidence built up with loading. As a horsey person myself I can tell you that horses can have a lot wrong with them besides a broken leg. Horses have very good memories for traumatic or upsetting experiences. It can sometimes take a lot longer to get them mentally "right" than physically.
I still love his commentary of Sea The Stars Arc:

Was the dun foal out of a sports horse mare? I was not aware that you could get pure thoroughbred’s that were dun. Such a sad story, I lost my own 10yo event mare last year to a sudden neurological condition. She was in the prime of her competition career, and the next day she was gone. It is extremely painful and upsetting.
I do not think it can be Midday either, because she was also a bright bay. It is not Timepiece either because she was a chestnut. The mystery continues…

Although I think a three-quarter sibling might also arise where two half brothers cover the same mare. Say Sea The Stars and Galileo cover the same mare.
I think Zarkava was covered by both STS and Galileo, but I am not absolutely certain.

Frankel and Bullet Train are three parts siblings because they share the same dam, and the sire of Bullet Train is the grand-sire of Frankel.
Edit: having read your post a few times, I think that you are describing the Frankel/Bullet Train Situation. The "horse" is Galileo, the "sire" is Sadlers Wells and the "mare" is Kind.
I was really surprised they let Catt go, because he was one of the most professional presenters on C4 racing, even if him and Emma had become a bit cringe-worthy to watch. When on his own he was very good.
Does anybody know just what losses the £3 million claim consists of? Surely not loss of earnings to that extent?

Thank for the info Cormack, I tried to find other foals from her because I knew with her age that she probably had at least one other. But using the Racing post, without a subscription you can only see the ones that have been through the sale ring or are entered for races in the UK.
Got to be between Snow Fairy and AL Kazeem now. Here’s hoping my favourite filly (and favourite horse in training) can win this prestigious race.
