Now that all steps within the internal horse racing review boards are exhausted, the case is going to hit the ordinary courtrooms in Cologne. The owner of 3rd placed Dschingis Secret is not letting this go.
I´m no legal expert, but it feels like we have a mini Bosman verdict on our hands that could have severe repercussions for horse racing in the not so distant future (at least in the EU).
I assume normal courts have very little interest in the nuances of horse racing and time for something that seems pretty straight forward. I´d guess the court will rule in favour of a DQ of the winner Isfahan and the runner-up Savoir Vivre for excessive use of the whip. Maybe they´ll go even further and ban the use of the whip completely. Who knows.
I`m actually in favour of the automatic DQ rule to be honest, cause neither the jockeys or owners care, if the race is just big enough.
I´m just surprised this case is not getting more attention so far.

The penalty doesn’t outweigh the gains. In fact, with stallion fees, etc, at stake the whip penalty can be safely disregarded as a factor when a jockey is assessing whether to get ‘stuck in’ or not.
Surely not the way things should be.
Automatic DQ of a winner when whip rules not followed is the answer. It’d solve the issue overnight.

Would be disastrous for British racing. The levy and in running betting would collapse and you wouldn’t know what you were watching. Results would be dependent on the opinion of one or two stewards which would vary from course to course, also an open door for corruption. I suspect it would be a time for people to walk away from the sport in their droves.
The chances of it happening are far more remote than the remote possibility of the whip being banned.
