I know they were running very late, but amazed there was no proper enquiry prior to the result being confirmed.
It looked from the angles that we were shown that the winner veered deliberately across the second – without clear daylight – which produced the knock on effect of bringing the horse down. If that was the case the winner was very fortunate not to be disqualified on the basis of dangerous riding.

THE 1895 DUKE OF YORK CLIPPER STAKES (CLASS 1) (Group 2)Permission was given for both AZURE BLUE (IRE) and KHAADEM (IRE) to go early to post, wearing a red hood; for MILL STREAM (IRE) to wear a hood in the preliminaries; and for MONTASSIB, SWINGALONG (IRE) and MARSHMAN to all wear a red hood to post, MARSHMAN also wore earplugs which were removed at the start.
MILL STREAM (IRE), lost its left-fore shoe on the way to post and had to be reshod, causing a delay to the start of this race.
Tom Marquand, the rider of TIBER FLOW (IRE) had fallen approximately 1 furlong from the line. The rider and Sean Levey, the rider of SHOULDVEBEENARING were interviewed and shown recordings of the incident, however William Buick, the rider of MILL STREAM (IRE) could not be interviewed as he had left the course. As a result of this, the enquiry was adjourned until the 16 May at York racecourse.
Approximately 1 furlong from the line, WASHINGTON HEIGHTS, placed fourth, shifted slightly left-handed, causing SWINGALONG (IRE), unplaced, to become momentarily short of room, but after viewing a recording of the incident, it was found that no riding offence was involved and that it had not improved the placing of WASHINGTON HEIGHTS.
May 16, 2024 at 20:40 #1694539The Stewards held an enquiry adjourned from Race 3 at York on 15 May 2024, into the fall of Tom Marquand, the rider of TIBER FLOW (IRE) approaching 1 furlong out. Tom Marquand and Sean Levey, the rider of SHOULDVEBEENARING, placed second, gave evidence on course yesterday before William Buick, the rider of the winner MILL STREAM (IRE) and Tom Marquand were interviewed today and shown recordings of the incident, with Sean Levey, the rider of SHOULDVEBEENARING, giving evidence over the telephone having been provided with recordings of the incident. The interference was found to be accidental in that Buick on MILL STREAM (IRE) had been tracking the leading division of runners who were generally all migrating left towards the far rail, before his mount had been briefly influenced left by SWINGALONG (IRE), unplaced, wandering slightly in front of him and this in turn resulted in MILL STREAM (IRE) carrying SHOULDVEBEENARING slightly off its intended line. A short distance later SHOULDVEBEENARING had independently shifted quickly left-handed away from MILL STREAM (IRE) into the path of TIBER FLOW (IRE) resulting in TIBER FLOW (IRE) clipping the heels of SHOULDVEBEENARING and falling.
This looks to me like a very convenient attempt to exonerate all parties in an ‘anything for a quiet life’ judgement. Unless I need a new pair of glasses Buick deliberately went left and the knock on effect sent the second horse left and eventually produced the fall. It would be nice to see the rear view for confirmation of how much Buick went across. As he is going across he is riding the horse forward so it was obviously an intentional move.
Had they found Buick guilty of dangerous riding it would have made it look pretty stupid that they didn’t hold an enquiry before they weighed in. You can’t really disqualify a horse 24 hours later.
