At its meeting today, the Horserace Betting Levy Board further considered the position of customers of betting exchanges in light of various submissions made to it in respect of its consultation, subsequent submissions and its legal advice.
By a majority vote, the Board rejected a resolution to institute Part 8 proceedings.
The Board considered making an application to the Court under Part 8 of the Civil Procedure Rules, designed for the resolution of certain disputes, but decided not to pursue that route for the following reasons (with one of the majority not accepting point 1 below):
1. The Board considered and
accepted the legal advice it had received from Lord Pannick QC and Michael Fordham QC, advisors to the Board, (which advice also took into account the views of those who had made submissions to the Board and the legal advice that they had received) that customers of betting exchanges (acting in that capacity) do not constitute leviable bookmakers under the Betting, Gaming and Lotteries Act 1963.
2. The risk that a Court would not regard the Part 8 procedure as appropriate in the circumstances.
3. The potential costs involved.
4. The ability of an interested party, which believes that the Board has reached the wrong conclusion on the law, to test that conclusion through Judicial Review proceedings.
Subsequently the Board also decided on the casting vote of the Chairman, in light of point 1 above, that it would not seek to impose levy on the customers of betting exchanges
I can’t see what is inconclusive in the advice of 2 (not 1) prominent QCs that a bid would fail. I wonder how much this will cost and what percenatge Hills will pay?

October 12, 2011 at 07:41 #19848Tim Morris, Paul Roy, Jamie Stier and Paul Struthers have all tendered their resignations over the continuing furore with regards their new whip rules they introduced on Monday, they have been advised to clear their desks by Champions Day.
They are to be replaced by Mark Johnston, James Willoughby, Matt Chapman and Pinza.The new team have stated that their first act will be to "immediately rescind the farcical new whip rules".
What a relief! For the first time in a long while I’m quite optimistic about the future of our sport.

We are all familiar with the disaster the BHA orchestrated on National Day that has done untold damage now we have the craziness of these new whip rules.
What will Qipco be making of British horse racing? All we hear is whip whip whip rather than what we should be talking about, Qipco Champions Day. Charles Barnett sounded as if he was talking through gritted teeth when asked about it last night.
Also bear in mind Qipco own Strong Suit so no Richard Hughes for their horse in the Breeders Cup.All the scientific evidence points to the whip being neither cruel nor painful for the horse so let people take the sport to court even the RSPCA, maybe they should be dealing with cruelty to animals instead.
I think they would have great difficulty getting a conviction in a court of law based on public perception.
Maybe it’s better in the long run for it to go to court if someone wants to take it there rather than all this nonsense.What a disaster, non stop bad publicity for the sport and all it’s own doing.
More scaremongering from Paul Struthers on R5 last night as well as contradicting Paul Roy. still available online.

October 26, 2011 at 22:11 #374357Paul Struthers is on what would some would say very well-earned paternity leave – his recent absence, for me, is akin to the fabled Dutch youngster who plugged the hole in the dyke, taking a break due to exhaustion. (see footnote for extension of this clumsy allegory for racing)
Mr Roy and Mr Stier, should indeed have been much more visible and proactive.
Dutch legend has it that there was once a small boy who upon passing a dyke on his way to school noticed a slight leak as the sea trickled in through a small hole. Knowing that he would be in trouble if he were to be late for school, the boy pocked his finger into the hole and so stemmed the flow of water. Some time later a passerby saw him and went to get help. This came in the form of other men who were able to effect repairs on the dyke and seal up the leak.
This story is told to children to teach them that if they act quickly and in time, even they with their limited strength and resources can avert disasters. The fact that the Little Dutch Boy used his finger to stop the flow of water, is used as an illustration of self-sacrifice. The physical lesson is also taught: a small trickle of water soon becomes a stream and the stream a torrent and the torrent a flood sweeping all before it, Dyke material, roadways and cars, and even railway tracks and bridges and whole trains.

Owners to be subject to tough new rules on lay bets.
New legislation replacing code of conduct to come into effect on Nov 1st.Oct 28th
New laying rule for owners to be delayed until April.
The BHA U turn is due to time needed to consider how the rule will "impact upon certain people who use technology for automated betting purposes which might cause them to be, unknowingly in technical breach of the rule".How many owners do you know/or is there who use automated betting systems?
How much consultation did the BHA have on the issue?Another excellent example of the BHA not having a clue.
10 months to come up with 7 whip strokes in a flat race and 5 in the final furlong. So they thought it was acceptable for 30 jockeys in a Hunt Cup to all look up and seek out the furlong pole instead of concentrating on riding a race, unbelievable they’ve been allowed to get away with it.
How can anyone have any confidence in them to run the sport?

Shame he and his team advised the tote be sold off to a tax-avoiding bookmaker rather than keeping it, and all its profits, within racing to offset the inevitable decline in levy from other tax-avoiding bookmakers.
