    Had heard there was something “going on” (edited) a while back, he has a horse entered in the next few days but Mitch Bastyan seems to be riding more for Milton Harris…..

    For it to be serious enough for a lifetime ban to be felt necessary I would have to wonder if there were not a criminal case to answer too.

    Presumably for a criminal case to be pursued, the “young person or adult at risk” that the BHA deemed to have been affected by his conduct would have to be dragged through the whole court process. If Farrelly feels that he has been unfairly punished then perhaps he could sue the BHA for depriving him of the ability to make a living in his chosen career, if such laws exist.

    In addition to the breaches of section 4 which was quoted in the article, they also mentioned a breach of section 6 which was not, so I looked it up. Section 6 is to do with co-operating with the investigation and not acting to the deteriment of whistleblowers, and there is also a warning against false/ malicious accusations of safeguarding breaches.

    A criminal case has a much higher burden of proof than a disciplinary hearing, so I doubt Farrelly will get very far if that is his defence.
