Of course not. The rules are perfectly unclear.The authorities will apologise to Mr.Henderson and see that this does not happen again.

I believe international action is needed to make horse racing regain its reputation.
Sometimes they call "rebels" the people who write in high profile forums -such as this one. But while we are usually objective, they have n’t heard how they talk down the street and in the pubs.

I’m sure your dad would be able to tell you that at Westminster School it’s not the custom to condemn people for their "demeanour" [sic.] because individuality and self-reliant confidence to stand out against the crowd are valued there – or at least they were through the times of such luminary Old Boys as Tony Benn and Nick Clegg.
Just because you like to call Henderson witty and amusing names associating him with the "privileged" aristocracy does not mean that the BHA lets him off the hook. Why not read their judgements on the various matters under discussion before claiming (falsely) that they do?
