I was shocked and saddened to read this report in today’s RP. I can’t help thinking that Chris Kinane’s family have been badly advised.
Of course the accident was an appalling tragedy.  But the horseracing world has responded with tremendous generosity, and this action, if it goes ahead, can only dissipate some of the goodwill that has been generated.
As usual, the only beneficiaries in cases like this will be the lawyers.
July 25, 2006 at 17:39 #74079I’m not sure about this ~ possibly the ugliest thread to arise on TRF was the one about Ray Cochrane suing over the crash of the aircraft in which pilot Patrick Mackey died. Cochrane sued Mackey’s family, but I believe that that is simply the way legal proceedings must happen in order for insurance money to be paid to the injured party. I may be wrong and will ask around to clarify.
July 25, 2006 at 18:03 #74080The same thread sprang to my mind. Semple is insured against such risks so it will simply be a case of the insurance companies arguing the toss. Whether there’s any merit in the claim remains to be seen.

In most cases, it’s the insurance company that pays out the compensation.
It’ll probably be the same in this situation.
If so, they’re not having a go at Semple, but just following the system.

July 25, 2006 at 20:44 #74082No I think there’s more to this than just the obvious. The accident happened in April 2005, so there has been more than ample time to settle insurance claims. Ian Semple has said that his Insurers at the time have refused to renew his premium — the implication being that they have already settled the 3rd Party injury claim.
What is different here is that Ian Semple is being sued personally for negligence. Of course such an action couldn’t possibly succeed, or could it? The implications for Trainers, and Owners, don’t bear thinking about.

From an Insurance Trade publication this month:-
"Research carried out of over 90,000 personal injury claims… showed that claimants without legal representation receive on average £289 more than claimants with legal representation. In addition, the research found that the time taken to settle claims without legal representation is on average 95 days shorter."
So please don’t automatically assume that using lawyers is the best route. Like any profession, there are brilliant and efficient exponents of their trade and at the other end of the spectrum are the parasites and moneygrabbers (e.g. the glut of “human rightsâ€ÂÂ
