AN ENQUIRY TO BE HEARD BY THE DISCIPLINARY PANEL ON 23 JUNE 2011
• Heather Royal, trained by Nicky Henderson, tested positive for Dexamethasone after a race at Huntingdon in February
HFL Sport Science has reported that the analysis of the urine taken from HEATHER ROYAL, trained by Nicky Henderson, after finishing unplaced in the EBF/DBS Mare’s Standard Open National Hunt Flat Race at Huntingdon on 10th February 2011, has revealed the presence of Dexamethasone, a prohibited substance within the meaning of Rule C (53) of the Rules of Racing.
This finding has been confirmed by Laboratoire des Courses Hippiques (LCH France), who performed the counter analysis.
The Disciplinary Panel of the British Horseracing Authority will hold an Inquiry to consider whether:
1) Nicky Henderson acted in breach of Rule (C)53 of the Rules of Racing in respect of the finding of Dexamethasone in the urine sample taken from Heather Royal;
2) to take action in respect of the possible disqualification of the mare under Rule (A)74.2 Ground 3;
3) Nicky Henderson acted in a breach of Rule C(13) of the Rules of Racing in respect of his failure to keep complete medication records.
A hearing is scheduled to take place on Thursday 23rd June 2011.

Guide to PenaltiesThe current guideline penalties are as follows:
Rule (C)13 – Incomplete Medication Records
Entry Point – £500
Range – £250 to £2000Rule (C)53 – Positive sample in error/on veterinary advice
Entry Point – £1000
Range – £750 to £10000[/color:3nxkdr2r]I’m presuming this is the case referred to around the same time as the Binocular withdrawal

June 8, 2011 at 15:34 #359588The lack of scrutiny is a disgrace….the racing media would crucify a American trainer or a Auzzie trainer for such abuse yet Henderson gets a free pass. I am sorry as i actually like the man and is a fantastic trainer but rules are rules and if you repeat to break them you deserve to get the full for of the law or BHA law brought on you.

Maybe Henderson should make up his own "Rule 10"
Rule 10: Any positive samples will be void under the act of trying to defraud Nicky Henderson PLC.

June 8, 2011 at 16:20 #359601Presumably this is the horse that tested positive for the allergy drug that should have cleared the system before the race, and prompted the testing/withdrawal of Binocular from the Champion Hurdle? It’s the same substance and the timing looks about right.
June 8, 2011 at 16:33 #359603Footballers and athletes have been banned upto nine months (if not more) for simply failing to give a urine sample, the punishments for testing positive have known to be far greater.
Here we have a racehorse trainer breaking the rules in this manner, and the worst that is going to happen to him is he will receive a few grand fine.
And people wonder why there is so much corruption in the sport
June 8, 2011 at 16:36 #359604Oh yes i do remember that their was another horse involved. At least it isn’t a new case. I wonder again why it has taken near on 3 months for this to reach a conclusion like Johnson getting 6 months or so.

Three months because the ‘B’ sample was sent to France for testing in their lab, as per the rules, and that means operating on French time. If you’ve ever joined the queue at a French Tote window to have a bet, you’ll know what that means.
