    It would only be another pin prick, but it might help to discourager les autres if the handicapper was ordered to return this horse to the mark it had before it’s tranquil performance at Folkestone and the sedate follow-up at Fontwell.

    When did this come to light? There is no date on the BHA’s report and no mention of it, that I can find, on Racing Post today.

    Whenever it happened, I share the astonishment/bafflement that the punishment is a piffling fine rather than something far more serious.

    The more you think about it the more baffling it gets really. Particularly when you consider the sentence Henderson received for administering TA to a bleeder, with no betting implications.

    RESULTS OF ENQUIRIES HEARD BY THE DISCIPLINARY PANEL ON THURSDAY 5TH AUGUST 2010 (IN ABSENCE)

    In absence:

    Tim Vaughan

    The Disciplinary Panel held an enquiry to establish whether or not Tim Vaughan, a licensed trainer, had committed a breach of Rule (C)12 of the Rules of Racing concerning his failure to check the identities of PIMENT D’ESTRUVAL (FR) and BEN’S FOLLY (IRE) when the geldings had come into his care. The matter was drawn to the attention of the Authority by the Veterinary Officer on duty at Market Rasen on 11 June 2010 following his inability to identify PIMENT D’ESTRUVAL (FR) from the markings shown in the gelding’s passport. Further investigations have shown that the gelding sent to Market Rasen was in fact BEN’S FOLLY (IRE) also trained by Vaughan.

    The Panel accepted an admission from Vaughan that he was in breach of Rule (C)12 in that he failed to check the geldings’ identities when they had arrived at his yard from Ireland on 30 October 2009. Noting that it was some 6 months before BEN’S FOLLY (IRE) first ran at a Point-to-Point, the Panel were somewhat surprised that during this period the trainer had not identified the mix-up in identities between the 5 year old and 7 year old geldings.

    The Panel noted that Vaughan had since taken steps to prevent a repetition of the offence, including the purchase of a microchip reader, however it imposed a fine of £1,000 upon him.

    Barney Curley / THE BONUS BALL (IRE)

    The Disciplinary Panel held an enquiry into the analysis of the urine ordered to be taken from THE BONUS BALL (IRE), trained by B J Curley, by the Stewards at Folkestone after the gelding had pulled up in the Ladbrokespoker.com Handicap Hurdle on 3 March 2010. The Panel also considered whether or not to take action under Rule (C)13 of the Rules of Racing in that he failed to keep full and detailed medication records.

    The urine taken from THE BONUS BALL (IRE) was found to contain a metabolite of acepromazine (ACP), which is a prohibited substance. The trainer exercised his right to have the ‘B’ sample analysed which confirmed the original finding. After considering the evidence, including a statement from Curley, the Panel was unable to establish the source of the substance, and could not therefore be satisfied that the administration of the substance was accidental.

    The Panel accepted an admission from Curley that he was in breach of Rule (C)53 and fined him £1,000. It ordered him to pay £400 towards the cost of the analysis of the ‘B’ sample having regard to the knowledge and information available to the trainer when he was interviewed. The Panel also found him in breach of Rule (C)13 and fined him £300 in that the yard’s medication records did not detail the administration of ACP and the brief diary entries maintained by Curley’s assistant trainer were not kept in sufficient detail as to satisfy the requirements of the Rule.

    The Panel informed Curley that all the horses in his care will be the subject of examination and the taking of samples for analysis provided for in Rule (A)49 within the next 12 months.

    Jeremy Glover / SLIKBACK JACK (IRE)

    The Disciplinary Panel held an enquiry into the analysis of the urine ordered to be taken from SLIKBACK JACK (IRE), trained by J A Glover, by the Stewards at Kempton after the gelding had finished unplaced in the Digibet Casino Handicap on 31 March 2010. The Panel also considered whether or not to take action under Rule (A)74 of the Rules of Racing in respect of the possible disqualification of the gelding.

    The urine taken from SLIKBACK JACK (IRE) was found to contain paracetamol, which is a prohibited substance. The trainer exercised his right to have the ‘B’ sample analysed which confirmed the original finding. After considering the evidence, including a statement from Glover, the Panel was unable to establish the source of the substance, and could not therefore be satisfied that the administration of the substance was accidental.

    The Panel accepted an admission from Glover that he was in breach of Rule (C)53 and fined him £1,000. It was not asked by the BHA to contribute to the costs associated with the analysis of the ‘B’ sample. Under Rule (A)74 the Panel disqualified SLIKBACK JACK (IRE) from the race.

    The Panel informed Glover that all the horses in his care will be the subject of examination and the taking of samples for analysis provided for in Rule (A)49 within the next 12 months.

    Keith Goldsworthy / PUTNEY BRIDGE

    The Disciplinary Panel held an enquiry into the analysis of the urine ordered to be taken from PUTNEY BRIDGE, trained by W K Goldsworthy, by the Stewards at Ludlow after the gelding had been placed first in the Corve Selling Hurdle on 24 February 2010. The Panel also considered whether or not to take action under Rule (A)74 of the Rules of Racing in respect of the possible disqualification of the gelding.

    The urine taken from PUTNEY BRIDGE was found to contain tetramisole, which is a prohibited substance. The trainer exercised his right to have the ‘B’ sample analysed which confirmed the original finding. After considering the evidence, including a statement from Goldsworthy, the Panel was unable to establish the source of the substance, and could not therefore be satisfied that the administration of the substance was accidental.

    The Panel accepted an admission from Goldsworthy that he was in breach of Rule (C)53 and fined him £1,000. It was not asked by the BHA to contribute to the costs associated with the analysis of the ‘B’ sample. Under Rule (A)74 the Panel disqualified PUTNEY BRIDGE from the race placing TABARAN (FR) first, SUPER FLY second, HOAR FROST third and TESSERAE fourth.

    The Panel informed Goldsworthy over that all the horses in his care will be the subject of examination and the taking of samples for analysis provided for in Rule (A)49 within the next 12 months.

    Pru,

    It appears to be just one of a job lot of disciplinary enquiries conducted by the same panel on August 5th.

    On another point, since ACP is only likely to be found in a test if it has been administered within the last 12 hours, the idea that the trainer was unable to explain it’s presence is barely credible.

    Or perhaps he had invited Dermot Browne for breakfast …..

    I feel sorry for the innocent horses.
    If trainers, who after all are in charge of these horses, have a prohibited drug administered by person/s supposedly unknown, they should be made responsible and banned for a considerable period, if not for life, unless it is their first offence.

    Nicky get a ban for giving a horse a medicine to stop bleeding and Barney gets a small fine for puting a horse to sleep during a race??????????????????

    If "The Rabble" were the only ones incapable of applying drug related penalties/violations in sport, I’d have a rant about it, but they’re not.

    It’s still incredible, though, and I’m starting to have some kind of sympathy for Nicky Henderson.

    I don’t have any sympathy for any trainer whose horse is found to have a banned substance when tested, unless it is a first offence. It is time to make trainers responsible for all what happens including not only the condition of their horses, but the way they are ridden in races.
