The judge has deliberately stated that this judgment does not set a precedent for racing or any other sport. I hope so. Each case has to be judges strictly on it’s own merits.

If we’re right, I expect more cases for negligence against those who ought to be preventing jockeys from riding under the influence, and I hope this isn’t restricted to front line staff. No doubt they will point to Oisin Murphy to demonstrate that enforcement has improved, and that may or may not be the case, but the system was clearly failing in 2016.
December 21, 2021 at 19:20 #1573717If this is allowed to stand, then we might have a lack of jockeys some day. No one will be willing to take so much responsibiltiy when riding just for 80-90 quid per horse. All of a sudden, after six years, everybody starts remembering too many details for my liking and some inexperienced judge finds you guilty for a riding offence that is hard to explain, if you’re not daily involved in this sport.
Insurance companies won’t cover the risks either…. I feel very sorry for Freddie, but I’m not quiet sure I understand the judge’s decision.

Considering just how much racing there is, this is (fortunately) a very rare case so I would like to think that it would be a wake up call to the jockeys (another one following on from the Frost/Dunne fallout) for them to be more circumspect of others around them when riding.
For me the big issue could be the insurance side of things when that comes up for renewal as some pretty smart talking will be needed to convey just how rare this incident is and that it shouldn’t have an negative impact of companies wanting to do business with the sport…..there will always be an element of risk but hopefully premiums quoted remain at a realistic price.
